Terms of Service

1. Acceptance of terms

By joining the waitlist, requesting an AI Visibility Check, or otherwise using Pinpulse ("the Service"), you agree to these Terms of Service. The Service is operated by FalkeLabs LLC (doing business as Pinpulse), New York, USA. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization.

2. Description of Service

Pinpulse is an AI-visibility platform: it measures how often AI models (ChatGPT, Claude, Gemini, Perplexity, and others) mention a brand in their answers — its "Share of Model" — and helps grow that visibility. The Service is currently in private beta.

3. Beta status

  • Access to the product is granted by invitation, typically from the waitlist.
  • During the beta, features may change, be limited, or be discontinued without notice.
  • We do not guarantee availability, uptime, or continuity of the Service during the beta.

4. Eligibility

  • You must provide accurate information when joining the waitlist or requesting a check.
  • You must be at least 18 years old to use the Service.
  • The Service is intended for business use.

5. Your inputs

  • When you submit a company domain, brand name, or category, you represent that you are entitled to have it analyzed.
  • We use your submissions solely to provide the Service; to produce a check, the domain and category you submit may be included in queries sent to AI models.
  • We do not use your data to train AI models.

6. AI-derived measurements

  • Share of Model scores and related metrics are estimates based on sampling AI model responses at a point in time.
  • AI model outputs are probabilistic and change over time; results may vary between runs.
  • Pinpulse does not guarantee any specific visibility, ranking, or business outcome.

7. Pricing & payments

  • The website offers no paid checkout during the private beta.
  • Pricing shown on the website (Snapshot — free; Growth — $249/month; Agency — custom) is informational only and does not constitute a binding offer.
  • Paid engagements during the beta are concluded in a separate written agreement outside the website.
  • Future price changes will be announced with 30 days' notice.

8. Fair use

  • You may not use the Service to mislead, to spam, or to violate applicable law or third-party rights.
  • You may not scrape, resell, or systematically extract the Service or its reports without our permission.
  • We reserve the right to suspend access that abuses the Service.

9. Limitation of liability

Pinpulse is provided "as is" without warranties of any kind. We are not liable for indirect, incidental, or consequential damages arising from your use of the Service, including but not limited to lost revenue, data loss, or decisions made on the basis of visibility reports.

10. Termination

  • You may leave the waitlist or ask us to delete your data at any time.
  • We may suspend or terminate beta access that violates these terms, or end the beta program.
  • Upon termination, your data will be deleted within 30 days.

11. Governing law

The Service is operated from New York, USA. These terms are governed by the laws of the State of New York, USA, and disputes fall under the jurisdiction of the courts of New York, USA. Mandatory consumer-protection rights of EU/EEA consumers remain unaffected, and Pinpulse honors GDPR data-protection rights for EU/EEA users — see the Privacy Policy.

12. Changes to terms

We may update these Terms from time to time. Material changes will be communicated via email. Continued use of the Service after changes constitutes acceptance.
